A famous painting 149 years old, illustrating the intimate parts of a woman, is subject to a process involving a court in France, the social network Facebook and online censorship, inform theverge.com.
According to AFP, a Paris court ruled this week that has the power to decide on an action brought by a French teacher whose Facebook account was suspended after he posted a photo of "L'Origine du Monde" - a painting famous in the nineteenth century, of Courbet, showing private parts of a naked woman.
The man, whose name was not released, had filed a complaint against Facebook in a court of France, claiming that his rights to freedom of expression had been violated because the social network could not distinguish between art and pornography.
The painting in question (pictured below), made by Gustave Courbet in 1866, the Musée d'Orsay is exposed in Paris.
At a hearing held in January, the lawyer representing the interests Facebook argued that the French court has no jurisdiction in the case, because the man agreed to the terms of the social network, which states that complaints against the company may be judged only in the courts of California. But the court in Paris has agreed with this, stating that this clause is "unfair" on Thursday by a judgment which could create an important precedent for Facebook and other companies of its kind in the US.
"This decision will create a precedent for other social media and other Internet giants, which are used that are based abroad, especially in the United States to try to escape the French laws," said Stephane Cottin, lawyer teacher.
It will receive damages in the amount of 20,000 euros, according to Le Figaro.
Nudity and other explicit sexual content are prohibited by Facebook, according to EU standards for the site, although combinations of algorithms and external moderators company had problems in the past to distinguish art from obscenities.
